Prenuptial Agreement
“In distributing property in deceased’s wife’s estate, the premarital agreement between wife and her surviving spouse constituted a waiver of surviving spouse’s rights in property designated as separate property under the agreement, and thus, spouse’s claims to elective share, family allowance, and exempt property could not be satisfied using any property listed in the agreement, where the agreement specifically stated that it applied upon the death of either or both parties and specifically listed the premarital property that was covered.” Dowling v. Rowan 270 Va. 510, 621 S.E.2d 397 Va.,(2005).
